May 27, 2024 officer K was driving behind me (I was going the limit 40mph) when he procedded to the left lane and begun to speed. I asked him why he was allowed to speed. His answer was "I'm expemt" and he sped off over the speed limit. When I was close enough, hevcut me off without the use of his blinker, within 100 feet (more like with 25 feet) and I honked at him. I checked behind me and merged to the left. He got behind me. I told him to go to the gas station and that I wanted his name and badge number. I called my friend as I seen him reporting my plates through my mirror and wanted her to know because I was going to send a complaint. He lights were never activated, not even till now after I ended the phone call. Once the light turned green I pulled into the gas station because he activated his lights then. I was getting out to record our conversation, and get gas. I did not know I was being detained. I had never been pulled over. After I had somewhat got out he told me to get back into my car. I was gonna get back into my car but I wanted to look at my door because I whacked it on the gas pump when I got out. It was EXTREMELY QUICK how he snapped, he was already outraged. He grabbed my arm begun to twist in the arrest postion and said I'm under arrest. I told him this was an illegal arrest (I had not committed a crime nor was I told why I was being arrested!) that I have a shoulder injury over and over. I couldn't be cuffed from the back due to my strict mobility. He placed the cuff on me very tight. I was in a lot of pain. I asked him over and over to cuff me from the front. I am on partial disability. I can not reach, twist, etc. I am on workers comp and receiving medical treatment for my shoulder. He dismissed it, they all did (he called backup). He said I was resisting arrest but my arms cannot willfully move that way. He twisted the phone out of my hand and slammed it on the roof of the car and continued twisting my arms into postion. My shoulders cannot move into those positions. I kept repeating that I had a should injury and I can't move that way.
He wouldn't let me call my dad because he wanted my car towed. He damaged my cellphone (cracked the screen), his partners searched my car without consent or a warrant (I only gave permission to get my drivers license... not search my car without a warrant which I told them). His partners scratched my cars paint with the keys, slammed my doors (damage), went through everything even after I told them I had no weapons in the car other than pepper spray and a pocket knife (all legal in CA).
I never obstructed a police officer. I said I did not consent to a them (a man) touching me. I gave permission to the woman to get my keys. They searched me for weapons more than 4 times. It was excessive just like the police officer who arrested me. It was simple retaliation on something he could not prove because it never happened. His body came was activated until the arrest, so he lied that it was on, so my safety shield was gone. It was hearsay and nepotism.
He never asked for my name and claimed he had, I correted him, he asked for my drivers license. I appreciate straight forward questions, I will only understand what you say in context. I gave my name when he actually asked. I did not know to associate those two together. He wanted me to unlock the doors but I told him I'm cuffed. The doors were locked but still they begun trying to force the doors unlocked.
When a woman cameI gave permission to the woman. Car damaged intentionally after I stated mutiple times not to mess with my car. They refused to get the chief and sent out a sergeant.
Overall:
1) There was faulty reporting of reckless driving when the officer displayed reckless driving when he cut me off with blinkers, I never sped up to him, and he was never in front of me until he cut me off, as stated on the citations ("not based on presence but belief" of officer).
2) I did not resist arrest due to chronic health conditions, my mobility made it hard to arrest me. His extensive force caused a shoulder injury. I have medical documents of the doctors concern of a separation.
3) I did not obstruct an officer, I allowed a female officer to have access to my keys. I am legally allowed to have a female officer, and not be touched by a man! I do not consent to be searched for weapons I did not have on me
4) I was denied the chief.
5) My car was unlawfully searched without a warrant.
6) The police officer had shady conduct, bruised ego, displayed reckless driving and was "extempt" to give unnecessary and excessive force to a disabled individual.
7) I was search without consent.
8) It was very confusing, none of my rights were STATED. I was arrested very quickly, with excessive rage, aggression, and force.
9) Body cam was only activated on arrest.
10) Handcuffs were so tight by officer K I had swelling and marks. I have pictures. I continue to have nerve pain.
11) I was not given my rights, nor was I properly interviewed. No one wanted to hear my side of the story.
12) when the officer demonstrated his Reckless intent, I immediately called my friend to note this. She's a witness.
13) I do have medical documentation for the shoulder injury. I can fax it over. I have not uploaded it yet.
