This statement is a formal contest for the citation issued to me by a City of Kernersville Police Officer T M. Collins/Badge Number: C5220 on 4/19/2024 at Linville Springs Rd located in The City of Kernersville. I believe this citation was issued improperly and is not supported by law.
Firstly, the citation in question alleges that I was in excess of a speed of more than 35 MPH on a municipal street or highway which I firmly dispute. 1. While I was driving there was another car in front of me driving past the speed limit and the officer did not stop that vehicle. 2. The officer was parked in the garage of someone's home which is illegal to do. Furthermore, the issuance of this citation involved procedural errors that undermine its validity. The citation vehicle information says that I was driving a station wagon which I don't drive, I drive a 4 door sedan, 2. Citation says I was at a light which I was not. There are no lights on that public residential street. The citation also states that I was driving on the passenger side whereas I do not have a right side driving vehicle because I do not work for US Postal Service. This information describes issues with how the officer failed to follow proper procedures and has misinterpreted the law. The officer while giving me the citation stated that I should take a Drivers Ed because I am a dangerous driver. This statement that officer has said to was a violation of § 33.15 DUTIES, CONDUCT OF POLICE OFFICERS Section B (3). His comment was disrespectful, improper, unconstitutional and has violated my civil rights and 14th amendment right to travel.
