Officer Jack Loughery (Badge No. 363) followed a black motorist, Rick Pouncil, for a substantial period of time before pulling him over for going 5mph below the speed limit in the center lane. It is worth noting that there is snow on the embankments and it is dark out. Officer Loughery runs the driver’s license, which comes back valid, and calls his supervisor. While talking with his supervisor, he is heard on his body camera saying that he has no intention of writing any ticket. He then asks Pouncil to exit the vehicle. Pouncil does. While outside the vehicle, Pouncil and Loughery both mention how cold it is. Loughery then says he wants to search the vehicle. Pouncil initially declines and Loughery says they will wait for the K9 then. Pouncil finally says he will let Loughery search the vehicle because he doesn’t want to wait on in the cold.
