Prosecutor Misconduct No. 1723489302 - 356943840

On March 02, 2024 my adult son, who is now deceased, was arrested and charged with Failure to Disclose personal Identity, Obstructing Official Business, Resisting Arrest. My son suffered with a mental health disorder and while hallucinating and paranoid he needs more time to process information. He was outside of Drug Mart in Willard Ohio around noon and began to experience the aforementioned symptoms. It caused him extreme anxiety outside and around back to gather himself due to needing to buy some items. Due yelling out loudly while outside and out back, the Willard police department was notified of a young male with odd behaviors. WPD arrives and makes contact with my son and the Officer is missing clear signs of concerning medical conditions presenting before his eyes and hears. My son is clearly hallucinating and paranoid. The officer asks if my son has ID and Logan states no. The officer then states " I didn't ask you that", but he did. Logan hands him what he believes to be his ID and the Officer says that isn't an ID. It was a credit card. Logan laughs to himself about the mistake and gets his wallet out and gets his ID out. You can see on his face that he isn't sure if he should trust the officer (due to a previous issue in Dec 2023 where my son had his rights violated and was later abused by hospital staff and had every right to be suspicious of them) Logan retracts the arm he is handing the ID over with and looks at the Officer as though he is trying to see if he can be trusted. Then hands the ID over to the Officer and the Officer swats the ID out of Logans hand and says "Screw This" and tackles my son to the ground. Prosecutor James Sitterly had this video available to him yet continued to offer ridiculous plea deals. James Sitterly, withheld this evidence for 4 months from Logans attorney. Logans attorney admits that the Body Cam Footage showing that Logan was handing his ID to the Officer when the Officer decided "Screw This" and then used excessive force on a nonviolent person. Logan was innocent of the charges. Logan was in the beginning of the 4th episode of psychosis. This was sudden onset over 2 years prior and this date was only his 4th episode so we were all very new to the development of his psychosis. WPD per Chief Shannon Chaffins, was fully educated on Logans symptoms due to Logans support team ensuring to take time to properly educate the department on the symptoms that Logan experiences so that when he is seen in town during and episode his support team can be contacted. He had no criminal history prior to these charges and WPD knew these symptoms are part of the mental health disorder that my son suffered with. It should not be legal to arrest someone for their disability symptoms that cannot be controlled by the person. Logans attorney admits to receiving the body cam footage one week before his last scheduled hearing and all prior hearings were related to Prosecution offering Plea Deals when they knowingly held evidence showing that my son was complying but needed time to respond due to his disability. I believe this is the definition of Coercive Plea deals. Due to my sons condition when in an episode he was unable to be aware of regular tasks of daily living not to mention not able to keep track of days and weeks and time. He made his best effort when not in an episode however the episodes came on abruptly and took him from this reality. He missed a court date due to being symptomatic and the state took his bond money. Even when reported that Logan was symptomatic which is a medical reason for missing the court date. No different than if someone was injured and was at the hospital. They then offered him another plea deal stating he will back to jail if he refuses. He was in no condition to be sitting in jail nor should he have because of his disability and he did comply with the request of the ID and he was not violent or threatening in any mannerism.
