Magistrate Dalia Labrador engaged in conduct warranting review through a combination of administrative malfeasance, bias, improper demeanor and decorum, failure to apply required remedies, failure to ensure constitutional rights, non-performance of essential judicial functions, and retardation of access to justice, specifically in relation to her decision to deny a substantive hearing and instead confine the matter to an unduly narrow proceeding addressing only general custody issues. This limitation disregarded prevailing authority from the Colorado Court of Appeals, relevant federal guidance from the Ninth Circuit, and ongoing legislative initiatives directed toward addressing Child Support Enforcement–related parental alienation and its systemic consequences. The decision failed to account for, or fairly represent, the respondent’s expectation of equitable treatment under the agreed-upon arrangements and materially impaired the respondent’s ability to present a complete record of grievances and evidence. The narrowing of the hearing scope created procedural and constitutional deficiencies by foreclosing access to a meaningful opportunity to be heard, conflicting with due process guarantees, and obstructing the presentation of material information that could bear upon both the reliability of judicial findings and the credibility of institutional actors. It is further alleged that the manner in which the hearing was constrained and conducted demonstrated partiality, dismissiveness, and failure to exercise judicial discretion consistent with standards of neutrality, thereby reflecting issues of demeanor incompatible with judicial office. These cumulative behaviors resulted in avoidable delay, denial of equitable consideration, and administrative barriers that hindered proper adjudication and materially impaired access to justice, thereby triggering concerns that the actions and omissions of Magistrate Labrador affect her credibility and reliability.
