Assistant Chief Special Agent Daniel Joseph Miller has repeatedly been requested to identify himself by confirming his involvement in the matter at issue. Miller has ignored each request and has neither confirmed nor corrected the identifying information presented to him. This repeated nonresponse constitutes a deliberate failure to self-identify and obstructs meaningful accountability for conduct undertaken under color of governmental authority.
Miller’s refusal is potential impeachment material under Brady and Giglio because it reflects evasiveness, lack of candor, and an unwillingness to provide basic information necessary to verify his authority, involvement, credibility, and status as a potential witness or government actor. The conduct may impair the ability of an accused person, litigant, or reviewing authority to investigate Miller’s actions, discover credibility or disciplinary information, identify conflicts or bias, and challenge representations, evidence, or investigative conclusions attributable to him. Regardless of whether a particular statute expressly compelled a response, the repeated concealment or withholding of basic official-identification information bears directly upon Miller’s credibility, transparency, and fitness to be relied upon as a government investigator or witness and should therefore be preserved, disclosed, and evaluated as potential impeachment evidence.
