This complaint concerns the professional conduct of Dalia Labrador of the Cook County State’s Attorney’s Office. Ms. Labrador has engaged in a pattern and practice of misconduct that reflects systemic issues within the Office. Her conduct includes attorney misconduct inconsistent with professional and ethical obligations; the demonstration of bias in prosecutorial decision-making; the use of coercive plea bargaining tactics designed to pressure defendants into plea agreements under the threat of disproportionate sentencing exposure; and cooperative misconduct through coordinated actions with law enforcement or other officials, in violation of her duty of independent prosecutorial judgment. Furthermore, Ms. Labrador has repeatedly failed to disclose exculpatory and impeachment evidence as required under Brady v. Maryland and Giglio v. United States, thereby depriving defendants of due process. Her actions further constitute obstruction of justice through the withholding of information, interference with judicial proceedings, and impairment of due process. In addition, she has engaged in overcharging by pursuing excessive or unsupported charges to coerce plea agreements or secure convictions. Taken together, these actions by Dalia Labrador exemplify both individual prosecutorial misconduct and a broader entrenched pattern within the Cook County State’s Attorney’s Office. This conduct undermines constitutional rights, compromises the fairness of judicial proceedings, and warrants remedial action and inclusion on the Brady List to ensure accountability and the protection of the justice system’s integrity.
